Conciliation is a voluntary process in which the parties involved in disagreements, conflicts or controversies try to reach an agreement through the intervention of a neutral third party, without having to resort to the Courts.
This third person, a Conciliator, helps the parties identify problem areas and find mutually acceptable solutions.
Conciliation can be used in a wide variety of situations and in different areas such as commercial, civil, labor and consumer law, among others.
In some countries, Conciliation as ADR (Alternative Dispute Resolution), is a mandatory requirement before initiating a judicial proceeding depending on the subject matter and jurisdiction.
Conciliation is a private process, meaning that the details of the agreement reached are not made public.
Conciliation is often more cost-effective than traditional legal proceedings, as there is no need to pay attorney fees or litigation costs.
The parties have greater control over the outcome of the Conciliation process, as they have the ability to reach a mutually acceptable agreement.
Conciliation is less formal than traditional legal processes, which can reduce the stress and tension associated with legal issues.
The Conciliator is selected at the beginning of the Conciliation. The Conciliator may be selected by the parties involved in the dispute or appointed by an organization, such as a Court or a Dispute Resolution Center. The Conciliator will work with the parties to understand the different perspectives and concerns of each party.
The Adjudicator will then facilitate a dialogue between the parties, with the objective of helping them find a mutually acceptable solution. The Conciliator may propose solutions, but does not have the power to impose a decision on the parties.
Once the parties reach an agreement, it is recorded in writing and becomes a legally binding contract. If the parties do not reach an agreement, they may decide to resort to other forms of dispute resolution, such as Mediation or Arbitration.
